An Introduction to Mediation in MENA

The purpose of the lecture is to provide attendees with an introduction to mediation in the MENA region. This will involve a description of the general principles and models of mediation and case studies of mediation in the MENA region.
Prof Dr Jur Malik Dahlan | Principal, Institution Quraysh & Policy (iQ)
Prof. Dr. Malik R Dahlan is a prominent Arabian multi-jurisdictional qualified lawyer and one of the leading international regulatory law and public policy experts in the Middle East. He is an expert in negotiation theory and dispute resolution, an academic and rule of law activist, and regional and transnational political entrepreneur.
Prof. Dahlan is the Principal of Institution Quraysh for Law & Policy (iQ), a transnational law and policy think-tank and Chief Lawyer at the prominent multi-jurisdictional law firm, MBR Legal. He is also Founder and President of iPlatform, an independent global initiative looking into specific rule of law and governance challenges.
As a licensed GCC lawyer, Prof Dahlan represents an array of clients including private companies, government and quasi government corporations in the Middle East.
As a CEDR accredited mediator, Prof Dahlan has facilitated commercial dispute resolution as well as serving on pioneering initiatives in ADR in several jurisdictions. For instance, serving as the Founding Director of the Qatar Law Forum and the Qatar International Dispute Resolution Centre established in the Qatar Financial Centre (QFC), Doha; as a Fellow at the National University of Singapore in 2010 when he surveyed Asian models of dispute resolution to establish a better understanding on an Arabian ADR Perspective Wasatta; as legal adviser establishing the framework for the new King Abdullah Centre for International Engagement Project to introduce judges to American methods on ADR and access to justice.
In political mediation, Prof. Dahlan is one of ten United Nations regional experts in constitutional affairs, oil and gas selected by the United Nations Assistance Mission for Iraq (UNAMI) in 2009. He was also a Policy Consultant to the UK Foreign and Commonwealth Office and the United States Trade Representative on the accession of Saudi Arabia, and the Gulf Cooperation Council (GCC) to the World Trade Organization (WTO).
Prof Dahlan is a Board Director of the International Mediation Institute at The Hague. He is on the World Economic Forum’s Global Agenda Council on the Future of the Middle East. He also sits on the Massachusetts General Hospital President’s Council and serves as International Chair on the Executive Committee of the Harvard Law School Association.
Prof. Dahlan earned his Civil Law and Jurisprudential Studies degree in Jordan. He also received degrees in Government and in Middle East Studies from Harvard University and an LL.M from Harvard Law School. Prof. Dahlan completed his professorial qualification Habilitation Higher Doctorate (LL.D.) in Law and Public Policy at the renowned Al-Azhar University. He is currently a Visiting Fellow at the Lauterpacht Centre for International Law (LCIL), Peterhouse College, University of Cambridge and Visiting Professor at the Centre for Commercial Law Studies (CCLS), Queen Mary University of London.
Wolf von Kumberg | Managing Director, Global Resolution Services Limited
Wolf von Kumberg is the Managing Director of Global Resolution Services Limited, a provider of ADR consulting services. He is also a member of ArbDB Chambers, a London based provider of arbitration, mediation and dispute board services.
Wolf brings over 30 years of international legal and business experience to IDR. Having served as Legal Director and Assistant General counsel to Northrop Grumman Corporation and before that to Litton Industries Inc., he has unique knowledge related to global business in particular, in the Aerospace, Security, Energy and High Tech Industries. His practise involved most regions of the world and included, commercial, government and state entities.
He has extensive legal experience including as company director and providing legal advice in government procurement, corporate governance, compliance (FCPA, Bribery Act, OECD) and ethics,regulatory investigations, risk management, international corporate and commercial law, corporate secretarial and board management,corporate structure, international M&A, global banking, financing, taxation, export regulations, intellectual property and licensing, competition law, environmental issues, employment law, international litigation, arbitration, mediation, dispute boards and dispute management.
He is now applying this accumulated knowledge to the field of global commercial conflict avoidance and resolution, specialising in systems architecture, training, management and acting as a mediator, dispute board member and arbitrator.
He has held/ holds the following senior positions in the field of ADR:
• Former Chairman and current Director of the International Mediation Institute (IMI)
• Director and member of the Executive Committee American Arbitration Association (AAA)
• Chair of the Board of Management Chartered Institute of Arbitrators (CIArb)
• Member of the Steering Committee of the CCIAG (Corporate Counsel International Arbitration Group)
He is fully multilingual English and German and as well as socially proficient in French.
